H2B PROGRAM


The H2B Program operates under the provisions of the Immigration and Nationality Act which authorizes the admission of aliens workers into the United States for the purpose of temporary or seasonal employment in areas for which there are insufficient number of qualified US workers available.
H2B admission is limited to seasonal jobs with a maximum duration of 10 months and is “Employer Specific”. The H2B Worker can only worker for the certified Employer who petitioned for their services. It is unlawful for them to work for any other US Employer!
A total of 66,000 H2B Visas are allocated per each fiscal year. USCIS’ fiscal year is divided in two, so that no more that 33,000 visas can be issued during each six (6) month period. The H2B Visa release dates are April 1st and October 1st of each fiscal year. For the October release. You should file by the first week in June. For the April release, you should file by the first week of December. This way you insure that your application is filed before the visas run out.
